The family of a brigadier who is currently in prison has filed a petition with the Lahore High Court (LHC) seeking his release.

A military officer is under detention by an investigative branch of the armed forces due to allegations of corruption and anti-state activities. The wife of a serving brigadier, who held a director position in DHA Quetta and is currently in custody, has sought her husband's release through legal action, approaching the Lahore High Court.

Ummaira Saleem, the wife of Brigadier Akhtar Subhan, has filed a plea in the Rawalpindi bench of the Lahore High Court, seeking a declaration that her husband's three-month detention is illegal. In response, Justice Jawad Hassan of the Lahore High Court has instructed the government to provide charges against Brigadier Akhtar Subhan and directed Deputy Attorney General Siddique Awan to bring the relevant person involved in the case. The petition lists the Federal Defence Ministry, Adjutant General of the Army, and Commanding Officer 28 Military Police Unit as respondents.

The wife of Brigadier Akhtar Subhan informed the court that her husband was detained on June 22 and argued that the arrest was unlawful. During the hearing, the Lahore High Court judge inquired about past cases involving armed forces personnel, and the counsel cited numerous judgments where the court had nullified military officials' orders. However, the defense ministry contended that this case pertained to disciplinary proceedings, making it beyond the jurisdiction of the Lahore High Court. They also mentioned that the Supreme Court had previously outlined specific conditions for judicial review of military court proceedings.

The deputy attorney general argued that the detention of a serving military officer of general rank, who is under investigation for alleged anti-state activities and corruption, is in accordance with the Pakistan Army Act and is thus not illegal. The case was adjourned, and Justice Hassan instructed the officials to provide a comprehensive, written response to the matter.
